Terms of Use
Draft. These terms apply to the Plugin Music Booking app, which opens to invited testers soon. They will be reviewed and finalised before the app opens. Parts in [brackets] are still being decided.
1. About these terms
These terms apply to your use of Plugin Music Booking (the “service”), provided by Creative Urban Event, trading as Plugin Music and Plugin Music School, registered office: Rijnvoorde 33, 3085 TH Rotterdam, the Netherlands, Chamber of Commerce no. 74277324 (the “Company” or “we”). By creating an account you agree to them. Our Privacy policy explains how we handle personal data.
2. The service
Plugin Music Booking helps artists who book their own gigs, and the people who help them, track venues and festivals, pitch for bookings, manage gigs, and create riders, press kits and contracts. [During the test phase the service is free and offered “as is” to invited testers. Features can change or be removed.]
3. Your account
- You must be 16 or older and give correct information.
- Keep your password secret and use two-step login if you can. You are responsible for what happens in your account.
- Tell us straight away at support@pluginmusicbooking.com if you think someone else has access.
4. Your content
Everything you put into Plugin Music Booking - venues, notes, texts, photos, riders, contracts - stays yours. You give us permission to store, copy and display it only as far as needed to run the service for you (for example, to build your press kit, rider and contracts from it). This permission ends when you delete the content or your account, apart from backup copies that are removed on our normal schedule.
You are responsible for your content: make sure you have the right to use the photos, music links and texts you add, and that the information you send to promoters is correct.
5. Other people's data
If you store contact details of promoters, bookers or other people, you are responsible for having a lawful reason to do so under the GDPR. For that data we act as your processor: we process it only on your instructions (that is, to run the app for you), keep it confidential and secure, use only the sub-processors listed in the Privacy policy, help you answer requests from those people, and delete it when you delete it or close your account. 6. Acceptable use
Don't use Plugin Music Booking to send spam or bulk unsolicited email, to break the law, to upload malware, to try to access other users' data, to overload or probe the service, or to copy the service. We may suspend an account that does this.
7. Templates and information are not advice
Contract terms, pitch texts, rider templates, date estimates and other suggestions in the app are starting points. They are not legal, tax or financial advice. Laws differ per country: have contracts checked before you rely on them. Festival dates, deadlines and details can be wrong or out of date - always check with the venue.
8. Availability and changes
We work to keep the service available and your data safe, and we make regular backups, but we can't promise the service will always be available or error-free. Keep your own copy of important data with Download all my data. We'll give reasonable notice of important changes to the service or these terms.
9. Liability
[Lawyer to draft. Typical structure: liability limited to direct damage and to the amount paid in the last 12 months (or a fixed amount for free use); no liability for indirect damage such as lost bookings or profit; no limitation for intent or gross negligence, or where the law doesn't allow it. Consumer protection rules may apply to individual artists.]
10. Ending your account
You can stop at any time and delete your account in Settings; your data is then deleted as described in the Privacy policy. We may end or suspend your account if you seriously break these terms, and will tell you why. If we ever stop the service, we'll give at least [60] days' notice so you can download your data.
11. Paid plans
[Not applicable during the test phase. Add prices, billing period, cancellation, refunds and the 14-day withdrawal right for consumers before introducing paid plans.]
12. Law and disputes
These terms are governed by Dutch law. Disputes go to the competent court in Rotterdam, unless mandatory consumer law gives you the right to go to the court where you live. Please contact us first - most things can be solved by email.
